These terms and conditions ("Terms and Conditions") set the legal conditions that apply to the use of the e-platform www.bebechic.ch (the "Website" and “Websites”), any of its sub-domains, any other websites and any mobile/desktop application developed by/for SUR-MESURE.COM GmBH and all the services we provide (the "Services").

Please read these Terms and Conditions carefully and make sure that you fully understand them. If you use the Website or order products, you are accepting these Terms and Conditions.

When we refer to "www.bebechic.ch", "we", "us" or "our", we refer to SUR-MESURE.COM GmBH. Where we refer to "you" or "your" we mean the customer using the Services.

SUR-MESURE.COM GmBH (hereinafter referred to as the “Company”), a limited liability company to be incorporated under the laws of Switzerland, having its registered office address at c/o excent AG, Zweigniederlassung Zug, Bahnhofplatz, 6300 Zug, Switzerland is the owner of the e-platform (www.bebechic.ch) established to enable you to order products of exceptional quality.

PURCHASES

By completing the check-out process and placing an order by clicking the “Pay” button on the checkout page, you are entering into a purchase agreement with the Company. When you place an order, you will receive a confirmation email.

We reserve the right to not to accept your order in the event that we are unable to obtain authorization for payment and/or shipping restrictions apply to a particular item and/or a product that has been ordered is out of stock and/or the product does not satisfy our quality control standards and is withdrawn.

ELIGIBILITY TO USE OUR SERVICES

To make purchases on the Website you will have to provide your personal details such as correct name, phone number, e-mail, address and other information. You are required to be over 18 years of age, provide valid payment details and authorize SUR-MESURE.COM GmBH to process charges on your credit/debit card in the amount of the total price for your order.

You agree that we may use your personal information for anti fraud checks. This information may be disclosed to a credit reference and/or fraud prevention agency.

YOUR ACCOUNT

You agree that you use the site at your own risk and the Company is not responsible for it. Your unique identifier is your e-mail id. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. You are responsible for updating the same as we will send all communication on your order status and delivery details to your email id only.

PRODUCTS

The Company tries to be as accurate as possible in the representation of information on the Website. However, the Company does not warrant that product description or other content of this site is accurate, complete, reliable, current, or error-free.

We try to be as accurate as possible whilst showcasing the photographs and video-graphs of the products on the Website; however, the display settings may have an impact of the colours displayed. We cannot guarantee that they will always be accurate or complete. Colours and patterns may appear different based on the screen resolutions being used. The final garment may differ slightly from that of the image being displayed.

The products sold through our Website are for private use only and not for commercial or re-sale purposes. You do not have the right to export or transfer the products to embargo and sanctioned countries or territories as per the U.S. Treasury Department’s List of Specially Designated Nationals and Blocked Persons List or the E.U.’s Consolidated Financial Sanctions List.

IMPORT DUTY & TAXES

You may be responsible for Import duty and taxes. We have no control in regards to the amount of Import duty or tax costs that you may be liable to pay and we recommend that you reach out to your local authorities. Import duty or taxes can be invoiced to you directly from an third party appointed by us, a local courier or Governmental authorities.

Compliance with your local laws is under your responsibility.

RETURNS

As we are a second hand platform, we unfortunately cannot offer any returns. If you decide not to keep an item, please email us at info@bebechic.ch and send us the package within 72h of receipt. We will post it for resale and you will receive the full payment after the sale as we will wave our commission.

PRIVACY POLICY

The Company values its customers and respects their privacy. We collect customer information in an effort to improve your shopping experience and to communicate with you about our products and services. The Company recognizes that it must maintain and use customer information responsibly. We will not rent, give or sell your personally identifiable information to any outside organisation for that organisation's own use without your consent provided however that your address may be given to the shipping companies to deliver your product. Your data will not be provided to third parties for marketing.

All material on this site, including images, illustrations, audio clips, and video clips, are protected by copyrights, trademarks, and other intellectual property rights that are owned and controlled by us. You must not copy, reproduce, republish, upload, post, transmit or distribute such material in any way, including by e-mail or other electronic means.

CHANGES TO TERMS OR SERVICES

We reserve the right to update or modify these Terms and Conditions at any time in our sole discretion. If we do so, we will let you know either by posting the modified Terms and Conditions on the Website or by email communication. It is important that you check these terms regularly because if you continue to use the services after we have posted the modified Terms and Conditions on the Website, you are indicating to us that you agree to be bound by the modified Terms and Conditions. You may choose to discontinue using our service if you do not agree to be bound by the modified Terms and Conditions. Because the services are evolving over time, we may change or discontinue all or any part of the services, at any time and without notice, in our sole discretion.

FORCE MAJEURE EVENTS

Force Majeure Events including but not limited to earthquakes, tsunamis or other natural disasters, strikes, lockdowns, epidemics, war, civil commotion or the like, may have an impact on production and deliveries of the products. We shall not be liable and/or responsible for any delay that may occur on account of such Force Majeure events.

LIMITED LIABILITY

For all purchases made online, the Company’s liability extends to the value of the products purchased by the customer.

In no event shall we have any obligations or liabilities loss of profits, for loss of business or use, or for incidental, punitive, special or consequential damages, whether based on contract, tort (including negligence), products liability, or any other theory or form of action, even if we have been advised of the possibility thereof, arising out of or in connection with the sale, delivery, or use of the products or services. Our customers are expected to use our platform for personal use only.

GOVERNING LAW AND JURISDICTION

The courts of the Canton of Geneva (subject to any appeal before the Swiss Supreme Court) shall have exclusive jurisdiction on the matters arising from or in connection with this Agreement. This Agreement shall be governed by and construed in accordance with the laws of Switzerland, without having regard to the principles of conflicts of law of any jurisdiction.

SEVERABILITY

We respect your privacy. In compliance with data privacy laws governing the jurisdictions in which we provide our service, you may delete your account at any time. Upon any termination, discontinuation or cancellation of services or your Account, the following Terms and Conditions will still be apllicable
